Clause  1,  page  1,  line  6,  at end insert—

 

‘(1)    

The Secretary of State may put in place arrangements for pilot schemes to trial

 

directly elected policing and crime commissioners in a minimum of two police

 

areas and a maxium of four police areas under Schedule 1 to the Police Act 1996.

 

(2)    

These pilot schemes must be independently assessed as to their success in

 

strengthening policing governance and reducing governance costs after 12

 

months and the findings of such independent assessment must be laid before

 

Parliament for scrutiny.

 

(3)    

Parliament must then make recommendations to the Secretary of State as to

 

whether directly elected policing and crime commissioners should be put in place

 

in every police area in England and Wales.

 

(4)    

The Secretary of State must have regard to Parliament’s recommendations.

 

(5)    

In those areas selected to pilot schemes for directly elected policing and crime

 

commissioners, the following arrangements shall be put in place.’.

‘(8A)    

In discharging functions under this Act the police and crime commissioner must

 

not ask, require or encourage the chief constable to act in a manner which could—

 

(a)    

put the chief constable in breach of his attestation under oath in

 

accordance with Schedule 4 of the Police Act 1996; or

 

(b)    

conflict with the chief constable’s exercise of direction and control under

 

section 2(3).

 

(8B)    

If the chief constable reasonably believes that the police and crime commissioner

 

has asked, required or encouraged him to act in a manner that is prohibited under

 

paragraph (8A), he may notify the relevant police and crime panel.

 

(8C)    

For the avoidance of doubt, any purported direction by a police and crime

 

commissioner under section 8A has no legal effect.’.

The Police and Crime Commissioner in deciding which other staff to appoint

 

should publish a staffing plan:

 

(i)    

the total staffing requirement of the local policing body,

 

including all support teams for Police and Crime Commissioner

 

and the Police and Crime Panel;

 

(ii)    

evidence setting out the needs that this staffing structure is

 

intended to meet;

 

(iii)    

a comprehensive staffing budget including detailed job

 

descriptions for all roles at a salary of more than £30,000 per

 

annum or pro rata;

 

(iv)    

in setting out the staffing plan the Police and Crime

 

Commissioner must have regard for the likely workload of the

 

relevant local policing body and the diversity of the communities

 

served by that body.

 

(2B)    

The staffing plan must be published alongside the Policing and Crime Plan as

 

under section (5) and the views of the community must be obtained as under

 

section (14).’.
