Further evidence from BIS
On division of responsibilities between HMT,
BIS and others, overall responsibility for banking regulation
lies with the Tripartite structure (the Treasury, the Financial
Services Authority and the Bank of England). The FSA is responsible
for the capital resource requirements applying to banks. The EU
Capital requirements Directive and the recommendations of the
Basel Committee on Banking Supervision are also relevant here,
but the current requirements imposed by the FSA go further than
either of these.
BIS does not lead on this area and as the Secretary
of State mentioned in answering Nicky Morgan's question (71) the
Treasury clearly has major responsibilities in the banking sector,
not least because the Financial Services Authority reports to
the Treasury and therefore the Treasury has overall specific responsibility
for the regulatory environment affecting banks as well as bank
taxation. BIS does have other specific responsibilities with respect
to the banking sector: for instance, governance, competition,
consumer protection, and access to finance for businesses.
As for the issue of capital requirements inhibiting
lending, they impact on lending because they stipulate how much
core Tier 1 capital (ie equity) banks must hold for a given volume
of assets (ie loans). An increase in the capital requirement reduces
the amount that banks have available to lend, or forces them to
find other ways of raising capital (eg through a rights issue).
