2 Speaker’s Statement: Controverted Elections (Fermanagh and South Tyrone, Election Petition)

The Speaker acquainted the House, That, as required by section 144 of the Representation of the People Act 1983, he had received the following Certificate from the Judges appointed to try the Election Petition relating to the Fermanagh and South Tyrone constituency election on 6 May 2010.

We, the Right Honourable Sir Declan Morgan, Lord Chief Justice of Northern Ireland, and the Honourable Sir John Gillen, one of Her Majesty’s Judges of the High Court in Northern Ireland, being the judges selected pursuant to section 108(1) of the Judicature (Northern Ireland) Act 1978 and section 123 of the Representation of the People Act 1983 to be judges for the trial of parliamentary election petitions, do hereby certify, pursuant to section 144(2) of the Representation of the People Act 1983, that Michelle Gildernew, being the Member whose election was complained of in the petition presented by Rodney Connor on 27 May 2010, was duly elected.

3 Investor Compensation Schemes

Motion made and Question put forthwith (Standing Order No. 119(11)), That this House considers that the draft Directive to amend the Investor Compensation Schemes Directive (European Union Document 12346/10) does not comply with the principle of subsidiarity, for the reasons set out in the Annex to chapter 7 of the Third Report of the European Scrutiny Committee (HC 428-iii); and, in accordance with Article 6 of the Protocol on the application of the principles of subsidiarity and proportionality, instructs the Clerk of the House to forward this reasoned opinion to the presidents of the European institutions.-(Angela Watkinson.)
