6  Conclusion

19. We are satisfied that Julian Ashby has the professional competence required to chair the Regulation Committee of the Homes and Communities Agency. We would like to draw the Secretary of State's attention to the potential for a perception of conflicts of interest that could arise as a result of Mr Ashby holding remunerated, non-executive directorships with three not-for-profit companies raising funds for housing associations. In particular, there is an issue as to how his position as regulator would be addressed if he had to deal with regulatory issues affecting these companies. Subject to adequate arrangements being put in place to resolve these potential conflicts should they arise or be perceived to arise, we recommend that the Secretary of State proceed with the appointment, and wish Mr Ashby every success in the post.
