4. PORTS

That the Committee takes note of European Union Document No. 10154/13 and Addenda 1 to 5, a draft Regulation establishing a framework on market access to port services and financial transparency of ports; supports the Government’s efforts to seek an alternative text, which removes those elements of its provisions that risk harming the competitive edge of the UK port sector; and further supports the Government’s determination to secure solutions that recognise and protect the UK port sector as an exemplar of the claimed underlying objectives of the Proposal, since it is already fully competitive, efficient and actively investing to expand capacity.

As an Amendment to Mr John Hayes’ proposed Motion (Ports):

Line 8, at end add ‘but believes the Government must commit to rigorously seeking the co-operation of other Member States in order to achieve the objective of an alternative text; and calls on the Government to continue negotiating but to resist any aspects of the Regulation that are sustained or added that do not address the continued effectiveness of the UK ports industry and its employees and that frustrate fair competition between ports.’.

Notes:

On 2 July 2014 the European Scrutiny Committee recommended this Document for debate on the floor of the House (Fifth Report of Session 2014-15). The Government scheduled the Document for consideration in European Committee A on 3 September 2014, on which date the Committee adjourned without debating the Document. At its meeting on 3 September 2014, the European Scrutiny Committee reiterated its recommendation that the Document be debated on the floor of the House (Tenth Report of Session 2014-15). On 15 October the Committee also recommended that European Union Document No. 13764/14, a draft Regulation establishing a framework on market access to port services and financial transparency of ports (First reading: General approach) be debated with this Document (Thirteenth Report of Session 2014-15).

5. SUBSIDIARITY AND PROPORTIONALITY AND THE COMMISSION’S RELATIONS WITH NATIONAL PARLIAMENTS

That this House takes note of European Union Documents No. 12425/14, the 2013 Annual Report from the Commission on relations between the Commission and national parliaments, and No. 12424/14, the 2013 Annual Report from the Commission on subsidiarity and proportionality; recognises the importance of the principle of subsidiarity and the value of stronger interaction between national parliaments and the EU Institutions; deplores the failure of the outgoing Commissioner for Justice, Fundamental Rights and Citizenship to respond to national parliaments’ concerns about the proposal to establish a European Public Prosecutors Office; looks forward to the European Commission responding to the call of national parliaments and the European Council to strengthen national parliaments’ role in improving EU legislation; and welcomes the Government’s commitment to increasing the power of national parliaments in EU decision-making by strengthening and, where possible, enhancing current provisions.
