Summary and Committee’s conclusions

12.1As part of its approach to tackling marine litter, the European Commission has proposed to overhaul existing legislation on port reception facilities (PRF) to collect waste from ships. This will align the PRF Directive with the latest MARPOL (International Convention for the Prevention of Pollution from Ships) requirements. The transposition date for the Directive is 31 December 2020, which is the final day of the proposed post-Brexit implementation period.

12.2The Committee last considered the proposal at its meeting of 23 May 2018, and waived the scrutiny reserve in order to allow the Government to lend its support to a General Approach at the 7 June Transport Council. The Parliamentary Under Secretary of State (Ms Nusrat Ghani) has now written113 to confirm that a General Approach was indeed agreed and that the UK was able to support the text.

12.3The UK secured concessions in the following areas:

12.4It was also confirmed that the separate collection of waste from ships in port would be in line with the existing land-based waste framework. The European Parliament is expected to reach its first reading position in early October. The Minister will keep the Committee informed of developments in the remaining stages of this proposal.

12.5We welcome the improvements made to the text in the course of negotiations and await information from the Minister on the progress of discussions in the European Parliament, including any likely areas of contention between the European Parliament and the Council. We would also ask the Minister to confirm that the Government remains in contact with key stakeholders and to highlight any outstanding concerns among them. The document remains under scrutiny. We draw this chapter to the attention of the Transport Committee, the Environmental Audit Committee and the Environment, Food and Rural Affairs Committee.
