1.In its letter to the Department for International Trade of 30 October 2019, the Select Committee requested a memorandum on the following point:
Clarify whether section 56(11) is relied on as an enabling provision, and if it is, why it has not been cited in the preamble.
2.The Department for International Trade (DIT) does not consider section 56(11) to be an enabling power or other power relied on to make the statutory instrument; section 56(11) relates to Parliamentary procedure.
3.DIT notes paragraph 4.1.7 of the GLS Statutory Instrument Drafting Guidance (August 2018), which advises not to mention in the preamble provisions relating to Parliamentary procedure.
