Memorandum by the Department of Social Security


The Committee has requested a memorandum on the following point relating to the Social Security (Contributions) Amendment (No.3) Regulations 1998 (S.I.1998/2211).

    Footnote (g) indicates that the principal Regulations of 1979 have now been amended (in respects relevant to these Regulations) thirty times. Has the Department any plans to consolidate the 1979 Regulations as amended; and if so, on what timescale?

The Department accepts that it would be desirable to consolidate the Social Security (Contributions) Regulations 1979 ("the principal Regulations"). There are certain considerations which will affect the timing of a consolidation. First, there will be further amending Regulations prior to April 1999 under powers conferred by Part II of the Social Security Act 1998 (c.14). Secondly, there will be further Regulations in connection with the transfer at that time of the operational functions of the Contributions Agency to the Inland Revenue, announced by the Chancellor of the Exchequer in his Budget speech in March 1998.

Consolidation of the principal Regulations will be a major exercise. In view of the intended transfer, the Department will enter into discussions now with the Inland Revenue about commissioning work on the consolidation and its timing.
