Joint Committee on Statutory Instruments Twenty-Sixth Report


Memorandum by the Ministry of Agriculture, Fisheries and Food


  1. The purpose of this memorandum is to explain why the Directives identified in the Department's first memorandum, including the two Directives specified at paragraphs 2(b) and (c) of that memorandum to which the Committee has referred, were not supplied to the Committee with the above instrument.

  2. The Department accepts that copies of all relevant Community instruments should have been supplied to the Committee in accordance with paragraph 5.19(c) of the Statutory Instrument Practice and apologises to the Committee for its oversight in failing to comply with this requirement. Enclosed with this memorandum are copies of the texts of all the relevant Community instruments to which the Department's first memorandum referred, including the two Directives to which the Committee has referred.

  3. This memorandum has been agreed with the Scottish Executive Rural Affairs Department and the National Assembly for Wales Agriculture Department (the first memorandum was agreed with the Scottish Office Agriculture, Environment and Fisheries Department and the Welsh Office Agriculture Department).
