The Education (Mandatory Awards) Regulations 2000 (S.I. 2000/2123)

23. The Committee draws the special attention of both Houses to these Regulations on the ground that they are defectively drafted.

24. These Regulations, made under the Education Act 1962 and the Education Act 1973, provide for the payment of awards to certain students undertaking courses of higher education. Regulation 2 includes a definition of the expression "British Islands" which repeats the definition of that expression in the Interpretation Act 1978. The Committee asked the Department for Education and Employment to explain the need for this definition.

25. The Department, in its memorandum printed in Appendix 6, agrees that this definition (which has been included in previous versions of these Regulations since 1982) should not have been included, and it undertakes to remove this provision when the Regulations are next amended. The Committee accordingly reports regulation 2 for defective drafting, as acknowledged by the Department.
