Joint Committee on Statutory Instruments Thirty-Third Report


Memorandum by the Home Office


1. The Committee has requested a memorandum in respect of the above instrument on the following point:

    Section 88(2) of the Road Traffic Offenders Act 1988 requires the Secretary of State to consult with such representative organisations as he thinks fit before making regulations under section 84. Explain whether such consultations were undertaken and, if so, why this is not mentioned in the recital of powers (see paragraph 2.26 of the Statutory Instrument Practice).

2. Before making Regulations the Secretary of State consulted the representative organisations listed in the Annex.

3. The Department accepts that the fact that this consultation took place should have been recited in the preamble to the Regulations in accordance with paragraph 2.26 of Statutory Instrument Practice and regrets the oversight.
