1. The Committee have requested a memorandum on the

of the words "except for regulation 3" in regulation
1(2). If the intention is that regulation 3 should supersede the
equivalent provisions in the previous Regulations, explain why
these Regulations do not expressly revoke those provisions.
2. It is not the intention that regulation 3 should
supersede the equivalent provisions in the previous Regulations.
Budget Statements will have been prepared under those Regulations
some 12 months ago. The words "except for regulation 3"should
not have been included in regulation 1(2). They imply that regulation
3 will continue to apply to Budget Statements prepared for future
financial years. That is not the intention. Fresh Budget Statement
Regulations will be made for 2002/03. The Department apologises
for the error and will include a provision amending regulation
1(2) in the next regulations to be made under section 52 of the
School Standards and Framework Act 1998 (c. 31).
