Second Memorandum by the Department of Health

The National Health Service (Optical Charges and Payments) and (General
Ophthalmic Services) Amendment Regulations 2001 (S.I. 2001/414)

1. The Joint Committee on Statutory Instruments has, in connection with the above Regulations, requested a further memorandum on the following point:

    In its memorandum of 19 March the Department, states in response to the Committee's second question, that the Department intends to consolidate the 1986 Regulations as soon as resources allow. Elaborate on this response, indicating what plans the Department has for this work and, if work has not yet begun, when it is expected that it might begin.

2. Work on the consolidation of the Regulations has not yet begun.

3. Between now and the autumn of this year, in accordance with Ministers' wishes, the Department is giving priority to implementation of the Health and Social Care Bill, which will involve a heavy programme of drafting of subordinate legislation. The expectation is that this work will be substantially completed by the end of the year, when it is hoped that the resources should become available to consolidate the 1986 Regulations.
