Memorandum by the Lord Chancellor's Department

Inner London Court Staff Pensions Order 2001 (S.I. 2001/733)

1. The Lord Chancellor's Department submits this memorandum in response to the request dated 4 April 2001 on the following point:

    Article 2(1) refers to persons who "immediately before the making of this Order are regarded as members of the metropolitan civil staffs" for certain purposes. Should the reference to the making of the Order be a reference to its commencement?

2. Yes. This is an error for which the Department apologises. The reference to the making of the Order in article 2(1) should be a reference to the commencement of the Order.

3. The Department is drafting an amending Order immediately. It is intended that the amending Order will come into force on the day after it is made. The Department very much regrets that this will mean that there will not be 21 days between the laying of the amending Order and its commencement. However in view of the need to clarify urgently the pension position of those persons affected (although these are believed to be few in number) the Department considered it necessary to bring the amending Order into force without delay.
