Memorandum from the Department for Transport, Local Government and the Regions


1. The Committee has asked for a memorandum on the following points-

"Given that the principal Regulations of 1988 have now been amended on numerous occasions (and in respects relevant to the present Regulations 10 times, as indicated in footnote (c) at page 1), does the Department intend consolidating the principal Regulations to assist the reader?"

2. Eight of the ten amendment regulations listed in footnote (c) have as their principal aim the alteration of fees and charges for the testing of heavy goods vehicles and, therefore, each of these amendments will generally supersede the previous amendment. Only two sets of amendment Regulations have involved substantial amendments to the principal Regulations, namely S.I.1997/82 and 1997/263 and there have been a number of minor consequential amendments. Nevertheless, the Department is aware of the need for a consolidated instrument. It will undertake this task as soon as resources permit.
