Memorandum from the Department of Environment, Food and Rural Affairs


1. The Committee has requested a memorandum on the above instrument on the following point:

Explain the reasons for the fee increases made by this instrument, given that the fees were previously increased with effect from 1 December 2001.

2. The Department's usual policy is to increase fees for plant breeders' rights in July each year. This year's fees increase is therefore in line with normal practice. However, last year's fees increase was late: it did not take effect until 1 December 2001 because of delays in scheduling the necessary plenary debate in the National Assembly for Wales.

3. The late increase of fees was a contributory factor to the increased deficit incurred in the administration of plant breeders' rights by the Department in 2001/02. Whilst this year's fees increase will improve cost recovery levels, it is expected that the Department will continue to operate at a deficit in the administration of plant breeders' rights.
