Joint Committee on Statutory Instruments Thirteenth Report

Memorandum from the Foreign and Commonwealth Office

1. The Committee raised the following point on the above Order:

Explain why this Order amends the definition of "replacement passport" in the 1999 Order, when that expression is not used in that Order, either before or after the amendments made by this Order.

2. Inclusion of the term "replacement passport" in the definitions set out in Article 2 of the Consular Fees (Amendment) Order 2001 was a mistake. The term was used in previous Consular Fees Orders up to and including the Consular Fees Order 1998 (S.I. 1998/257). The term is used at paragraphs 16 and 17 of the Schedule to that Order.

3. The term is not used in the 2001 Order and an appropriate correction will be made at the earliest opportunity.
