Sex Discrimination (Clubs and Other Private Associations) Bill

38. The Sex Discrimination (Clubs and Other Private Associations) Bill,[48] introduced by Mr Parmjit Dhanda MP, would prohibit discrimination against women in mixed-sex clubs and similar places with 25 or more members. It advances the cause of equal treatment, which is a fundamental principle of human rights law, and so would enhance the protection of human rights. The Bill would engage the right to freedom of association (ECHR Article 11), which includes a right not to be forced to associate with others against one's will. However, any interference with that right would be likely to be justifiable under Article 11.2 in order to protect the rights of others, particularly the right to be free from discrimination.
