S.I. 2003/753: memorandum from the Department
National Care Standards Commission (Fees
and Frequency of Inspections) Regulations 2003 (S.I. 2003/753)
105. This memorandum has been prepared by the
Department of Health to explain the failure to observe the "21
day rule" in respect of the National Care Standards Commission
(Fees and Frequency of Inspections) Regulations 2003.
106. These Regulations consolidate with amendments
the National Care Standards Commission (Fees and Frequency of
Inspections) Regulations 2001. In particular, they provide for
an increase in the fees to be paid by certain establishments and
agencies registrable under the Care Standards Act 2000.
107. The consolidation exercise raised some difficult
issues which needed to be resolved, and which took time to do
so. Furthermore this took place at a time of considerable pressure
on administrative and legal resources and the task of preparation
had to compete with other urgent matters. As a result, unfortunately,
it was not possible to complete the drafting of the Regulations
at an earlier date.
108. The Department greatly regrets the need
in this case to breach the 21 day rule.
