Joint Committee on the Draft Charities Bill Written Evidence

Memorandum from Monro Fisher Wasbrough (DCH 37)

  1.  Clause 2(3)(c). Please clarify in subsequent draft whether "sport" must involve both "physical skill" and "exertion"; also whether the exertion must be physical.

  2.  Clause 27(7)(a). This sub-clause appears to undermine the entire Section 27 and appears to conflict with sub-clause (1).

  3.  Section 27(6)(d)(ii). There appears to be no definition of "substantial interest".

  4.  Schedule 6 Charitable Incorporated Organisations. No requirement, indication or guidance is given in relation to existing registration as a company at Companies House. Will this automatically terminate? Will notice be required by Companies House for removal? Will Companies House registration continue?
