Annex 1

  List of written notes from the meeting of the Joint Committee on the draft Charity Bill on 16 June 2004 that ACF agreed to send to the Committee.

  After each question, the paragraph number of the relevant response in the main paper is given.

  1.  On whether he [David Emerson representing ACF] agrees with Christopher Spence's [representing Volunteering England] suggestion that there should be ongoing testing of public benefit; and on whether there should be criteria in the Bill for such testing. (Qs149, 160) Paragraph 12

  2.  On whether education and (in part) health should be removed from the charitable sector and the Exchequer should tax or subsidise them in another way under other legislation. (Q156) Paragraph 13

  3.  On ideas for how the distinction between direction and advice from the Charity Commission especially to smaller charities could be made clearer. (Q170) Paragraphs 7 & 8

  4.  On revised wording to clause 5 of the Bill which would provide for lighter-touch regulation while ensuring proper accountability. (Qs 182, 183) Paragraphs 5 & 6

  5.  Providing specific examples of how people have been discouraged from creating new foundations because of the high degree of regulation. (Q 186) Paragraph 9

  6.  Providing statistical evidence as to the number of foundations that have been established in the past and any slow-up in the creation of new ones at present. (Q187) Paragraph 10

  7.  Providing evidence that points to other models of philanthropic giving that the Committee might find useful in thinking about how distinctions should be made within the Bill between grant giving and other sort of charity. (Q188) Paragraph 11
