Draft charities bill

1. We are in general content with the Charities Bill but we have 2 main concerns these are:

a. Trading

b. Charity Commission co-ordination for UK Charities

2. Trading. The Consultation Paper indicated that Charities would be allowed to trade without the necessity to set up separate Companies. This concession was welcomed as it would do away with the requirement for separate accounts, registering with Companies House, separate audits and other expenses. This however has been excluded from the Draft Bill. The Committee is asked to review the aspect of Trading.

3. Charity Commission co-ordination for UK wide Charities. The Draft Bill only applies to England and Wales. As a UK wide Charity with a Head Office in London, may the Charity Commissioner for England and Wales be designated as Lead Commissioner to avoid any requirement for registration in Scotland and Northern Ireland and for separate accounting and reporting arrangements.
