The Committee has considered the following instrument, and has determined that the special attention of both Houses should be drawn to it on the ground specified.

1 Town and Country Planning (London Borough of Camden) Special Development Order 2004: defective drafting


Town and Country Planning (London Borough of Camden) Special Development Order 2004 (S.I. 2004/1231)


1.1 The Committee draws the special attention of both Houses to this Order on the ground that it is defectively drafted.

1.2 Article 4 applies paragraphs (2) to (5) of article 8 of the Town and Country Planning (General Development Procedure) Order 1995 to land in the London Borough of Camden with specified modifications. In a memorandum printed at Appendix 1, the Office of the Deputy Prime Minister acknowledges that a necessary consequential modification to paragraph (6) of that article should have been included, and undertakes to correct this error shortly. The Committee accordingly reports article 4 for defective drafting, acknowledged by the Department.
