Appendix 4 S.I. 2004/1304: memorandum from the Home Office


Immigration (Passenger Transit Visa) (Amendment) Order 2004 (S.I. 2004/1304)


1. This memorandum is submitted to the Joint Committee on Statutory Instruments in response to its query on the following point in respect of the above Order:

The last sentence of the explanatory note states that article 2(3) adds Kenya and Tanzania to the list of countries whose nationals or citizens do not need a transit visa. Does the Department not agree that the effect of that article is that nationals or citizens of those two countries are required to hold a transit visa?

2. The Home Office agrees with the Committee's description of the effect of article 2(3) and offers its apologies for this oversight in the drafting of the explanatory note. In fact, this point had been identified by the Home Office prior to receipt of the Committee's request. Pursuant to this, the Home Office had already instructed Her Majesty's Stationery Office to issue a correction slip.
