Appendix S.I. 2004/1009: memorandum from the Department of Health


Health and Social Care (Community Health and Standards) Act 2003 Commencement (No. 2) (Amendment No. 2) Order 2004 (S.I. 2004/1009)


1. The Committee has requested a memorandum on the following point concerning the above Regulations:

Since this Order corrects an error in S.I. 2004/288 and a further error in S.I. 2004/866, explain whether arrangements have been made (as required by paragraph 3.4.11 of Statutory Instrument Practice) for copies to be made available free of charge to purchasers of those instruments. If so, explain why this Order does not bear a headnote to that effect, as required by paragraph 3.4.12.

2. The omission of the headnote was an oversight.

3. The Department apologises for this error and have asked The Stationery Office to refund all known purchasers of the instrument and to include a headnote on all future copies of the instrument.
