The Committee has considered the following instruments, and has determined that the special attention of both Houses should be drawn to them on the grounds specified.

1 Air Navigation (Amendment) Order 2004: unjustifiable delay in sending copies to the Committee


Air Navigation (Amendment) Order 2004 (S.I. 2004/705)


1.1 The Committee draws the special attention of both Houses to this Order on the ground that there was an unjustifiable delay in sending copies of it to the Committee.

1.2 This Order was laid before Parliament on 22 March 2004 and came into force on 13 April. Copies of it, however, were not sent to the Committee until 27 May, despite the requirement in paragraph 5.4.12 of Statutory Instrument Practice to provide copies of an instrument to the Committee as soon as it has been laid.

1.3 In a memorandum, printed in Appendix 1, the Department for Transport explains that it believed that the Privy Council Office (which was responsible for laying and registering the Order) would also provide the copies required by the Committee even though Table 10 in Part 7 of Statutory Instrument Practice requires departments to do this. The Department acknowledges, and apologises for, its error and indicates that the attention of relevant staff has been drawn to the correct procedure.

1.4 The Committee accordingly reports the Order for the unjustifiable delay in sending copies of it to the Committee.
