Appendix 1 S.I. 2004/705: memorandum from the Department for Transport


Air Navigation (Amendment) Order 2004 (S.I. 2004/705)


1. By a letter dated 22 June 2004 the Committee sought a Memorandum on the following point:

This instrument was laid before Parliament on 22 March 2004. Why was it not until 27 May that the Committee received copies of it? (The Department is reminded of Table 10 in Part 7 of Statutory Instrument Practice.)

2. The instrument was made by way of an Order in Council, the procedure for which requires the Department to submit laying and registration papers to the Privy Council and copies of the instrument to the Committee. The Department has established that, in error, it did not submit copies of the instrument in a timely manner, as required by Table 10 in Part 7 of Statutory Instrument Practice. It believed, wrongly, that all the documentation would be submitted by the Privy Council. The error came to the attention of the Department on 26 May and on 27 May the Department sent copies of the instrument to the Committee as a matter of urgency. The Department acknowledges its error and apologises unreservedly for the unnecessary delay caused. The attention of relevant staff has been drawn to the correct procedure.
