Appendix 3 S.I. 2004/1418: memorandum

Air Carrier Liability Regulations 2004 (S.I. 2004/1418)
1. By a letter dated 22 June 2004, the Committee
sought a Memorandum on the following point:
Article 4(1)(a) provides that a person guilty
of an offence under the Regulations shall be liable, on summary
conviction, to a fine not exceeding level 5 on the standard
scale. Ought not the underlined words to have read
"the statutory maximum", given that the offence is triable
either way?
2. The Department accepts that the underlined words
ought to have read as the Committee has indicated. It apologises
for this drafting error and undertakes to correct the Regulations
at the earliest opportunity.
