S.I. 2004/2590: memorandum from the Department
for Environment, Food and Rural Affairs
| Plant Health (Phytophthora ramorum) (England) Order 2004 (S.I. 2004/2590)

1. The Joint Committee has requested the Department to submit
a memorandum concerning the above Order on the following point
-
What is the sanction for a contravention of -
(a) article 6(1) and (2);
(b) article 7(1) and (3).
2. The Department agrees with the Committee that
the Order should have included sanctions for contraventions of
article 6(1) and (2) and article 7(1) and (3). Such sanctions
were omitted inadvertently.
3. The Department regrets the omission and will amend
the Order at the earliest possible opportunity.
