Merchant Shipping (Prevention of Oil Pollution)
(Amendment) Regulations 2004 (S.I. 2004/303)
3.1 The Committee draws the special attention
of both Houses to these Regulations on the ground that they are
defectively drafted.
3.2 Paragraph (11) of new regulation 31 (inserted
by regulation 5) contains definitions of "age" and "double
hull tanker". In a memorandum printed in Appendix 3, the
Department for Transport acknowledges that the definitions should
have been omitted, since those expressions are not used elsewhere
in new regulation 31. It undertakes to correct the errors at the
next suitable opportunity. The Committee accordingly reports
new regulation 31(11) for defective drafting, acknowledged by
the Department.
