the Department for Transport
Private Hire Vehicles (London) (Transitional Provisions)
Regulations 2004 (S.I. 2004/242)
1. The Committee has asked the Department to submit
a Memorandum on the following points:
(1) Verify the references to paragraphs (4) and
(5) in regulation 6(1)(d) and (e) respectively, and explain the
circumstances in which regulation 6(1)(e) is intended to operate.
(2) In regulation 6(4), should not "1988
Act" have read "1998 Act"?
2. In response to point (1), the reference to paragraph
(4) in regulation 6(1)(d) should be a reference to paragraph (3).
Regulation 6(1)(e) is redundant and should have been removed before
the regulations were made. It is not intended to be operative.
3. In response to point (2), the reference should
indeed have been to the 1998 Act.
4. The Department apologises for not spotting these
drafting errors and undertakes to correct them at the next suitable
opportunity.
