S.I. 2004/462: memorandum from
the Department for Transport
Goods Vehicles (Licensing of Operators) (Temporary
Use in Great Britain) (Amendment) Regulations 2004 (S.I. 2004/462)
1. The Committee has asked for a memorandum on the
following matter:-
What steps will the Department take to inform
members of the public of the actual dates on which the agreements
referred to in the new regulations 13, 25, 30A, 30B, 30C, 30D
and 30E come into force?
2. All the provisions of the Regulations that refer
to a relevant Road Transport Agreement have effect as from the
date that Agreement comes into force. The relevant Road Transport
agreements are those the United Kingdom has signed since 1996
with the Czech Republic, Slovakia, Slovenia, Georgia, Moldova,
Croatia and the Former Yugoslav Republic of Macedonia. Each party
to these agreements must notify the other in writing that measures
necessary for giving effect to the agreement in their territory
have been taken. Each agreement enters into force on the thirtieth
day after both parties have notified each other.
3. When each agreement enters force, the Department
will formally notify in writing the three main trade associations
which were consulted in the drafting of the Regulations. These
are the Road Haulage Association (RHA), the Freight Transport
Association (FTA) and the Confederation of Passenger Transport
(CPT). These trade associations, which have been informally aware
for some time of the agreements, will then be able to inform
their members of each agreement entering force. The Department
will also publish the coming into force date of Road Transport
Agreements in the London Gazette and the information will be available
on the Department for Transport website.
