3 Animals and Animal Products (Import and Export) Regulations 2004: defective drafting


Animals and Animal Products (Import and Export) Regulations 2004 (S.I. 2004/853)


3.1 The Committee draws the special attention of both Houses to these Regulations on the ground that they are defectively drafted.

3.2 Regulation 13(2)(a) states that a notice shall require a person to take certain action in relation to animals or products, "and to take such further action in relation to them as may be so specified in the notice, and to take such further action in relation to them as may be so specified for the purpose of preventing the introduction or spreading of disease into or within England". In a memorandum printed at Appendix 3, the Department for Environment, Food and Rural Affairs acknowledges that it was not necessary to include both the words underlined and those that follow them, and undertakes to make an appropriate amendment when it next re-makes the Regulations, which it intends to do in two to three months time. The Committee accordingly reports these Regulations for defective drafting, acknowledged by the Department.
