Environmental Protection (Controls on Ozone-Depleting
Substances) Regulations 2011 (S.I. 2011/1543)
1. The Committee has asked the Department
for Environment, Food and Rural Affairs for a memorandum on the
following point:
What is the intended meaning of "the
offshore area" in regulation 8(3) and why is the expression
not defined?
2. The meaning of the term "offshore
area" in regulation 8(3) is intended to be the same as the
meaning of "marine area" in paragraph 1(1) of Schedule
1 to the Regulations, which term is defined.
3. The Department accepts that the
term should been defined for the purposes of regulation 8(3) (and
that the same defined term should have been used in each provision).
4. The Department regrets the oversight
and will correct the instrument when a suitable opportunity arises.
