Local Government (Discretionary Payments) (Injury
Allowances) Regulations 2011

1. The Committee has requested a memorandum on
the following point:
Why does regulation 11(4)(b) require an application
made by a person other than the claimant to "also" set
out information which is already required by paragraph (3)(a)?
2. We accept that regulation 11(4)(b) imposes
no obligation in addition to that imposed by regulation 11(3)(a).
3. We consider that the Regulations will operate
appropriately notwithstanding the otiose provision and have no
immediate plans to amend them.
