S.I. 2011/2971: memorandum from the Ministry of
Justice
Community Legal Service (Financial) (Amendment No.
2) Regulations 2011 (S.I. 2011/2971)
1. By a letter dated 25 January 2012, the Committee
sought a memorandum on the following points:
Explain the purpose of including definitions
of "TPIM notice" and "TPIM proceedings" in
regulation 1(4)
2. Having reflected on the point raised by the
Committee, the Ministry of Justice accepts that the definitions
of "TPIM notice" and "TPIM proceedings" in
the Community Legal Service (Financial) (Amendment No. 2) Regulations
2011 (the "2011 Regulations") are superfluous and need
not have been included in the Regulations.
3. The Ministry of Justice does not propose to
draft amending regulations for the sole purpose of removing the
superfluous definitions. As these definitions have no actual effect
on the operation of any legislation, the Ministry of Justice does
not consider that such amending regulations would represent a
reasonable use of departmental and Parliamentary resources.
