In its letter dated 5th
December 2012 the Committee requested a memorandum asking the
Department to"Explain the purpose and effect of regulation
2, given that the defined term does not appear to be used in the
Regulations."
The Department is grateful to the Committee for raising
this point. The Department accepts that the defined term in regulation
2 is not in fact used in the Regulations and that accordingly
regulation 2 is unnecessary. Reviewing the Department's internal
papers it appears that an earlier draft of the Regulations did
require such a definition, but subsequent revision rendered it
otiose. Unfortunately, this was not noticed when the Regulations
were sent for final checking. The Home Office is grateful to the
Committee for bringing this point to its attention, apologises
for the error and plans to correct the instrument in due course.
