1. The Committee has requested a memorandum on the
following points:
Explain to what extent or in what way the word "material"
is intended to qualify the effect of article 2(4)(b), having regard
in particular to article 2(5).
2. The inclusion of the word material is intended
to qualify the effect of article 2(4)(b) so that the application
or request is not required to be legible in absolutely every respect
but that it is required that the aspects of the document which
are relevant to the consideration of the application or request
are legible.
3. In article 2(5) the word "material"
has been omitted from the phrase "in all respects";
this should read "in all material respects". This
is a drafting error and an amendment will be brought forward at
the next opportunity.
