Quality Standards for Green Bananas (England
and Wales) Regulations 2012 (S.I. 2012/947)
1. The Committee has asked the Department for Environment,
Food and Rural Affairs for a memorandum on the following point:
Given that offences under these Regulations are
summary only (regulation 5), explain what the words "proof
of which lies on that person" in regulation 4(f) are intended
to add, if anything, to the effect of section 101 of the Magistrates'
Courts Act 1980.
2. The Department is grateful to the Committee for
identifying this duplication in legislation, which adds nothing
to section 101 of the Magistrates' Court Act 1980. The Department
will amend this provision at the next appropriate opportunity.
