1.In its letter to the Department dated 8th July 2020, the Committee requested a memorandum on the following point:
“In relation to regulation 3 (inserted paragraph (9)), clarify whether the period within which information must be supplied begins on the date on which a person is directed to provide that information, on the day after that date, or on some other day.”
2.The Department’s response to the Committee’s point is set out below.
3.The period within which the information must be supplied begins on the date on which the Secretary of State communicates with the landlord, this being the point at which the landlord is “required to” provide the information or evidence by the Secretary of State. The Explanatory Memorandum explains that this regulation has been inserted to enable communications about information to be made via an online tool and so the date of communicating the requirement to the landlord will be clear.
4.The drafting of the new paragraph (9) is consistent with the wording of other time limits for providing evidence and information in regulations 37 and 38 of the Universal Credit, Personal Independence Payment, Jobseeker’s Allowance and Employment and Support Allowance (Claims and Payments) Regulations 2013, for example regulation 38(7). Without extensive amendment of the existing regulations, using different wording could have suggested the time limit in new paragraph (9) had a different meaning, which is not the policy intent.
