Judicial Business 1. Effort Shipping Company Limited (Respondents) v. Linden Management SA and others (Appellants)—The Report from the Appellate Committee was agreed to; it was ordered and adjudged that the Order of the Court of Appeal of 30th January 1996 be affirmed and the appeal dismissed with costs, the amount thereof to be certified by the Clerk of the Parliaments if not agreed between the parties. 2. Redrow Homes Limited and others (Appellants) v. Bett Brothers plc and others (Respondents) (Scotland)—The Report from the Appellate Committee was agreed to; it was ordered and adjudged that the Interlocutors of the Second Division of the Court of Session of 14th March 1997 be affirmed and the appeal dismissed with costs, the amount thereof to be certified by the Clerk of the Parliaments if not agreed between the parties. 3. Strathclyde Regional Council and others (Respondents) v. Wallace and others (Appellants) (Scotland)—The Report from the Appellate Committee was agreed to; it was ordered and adjudged that the Interlocutors of the Inner House of the Court of Session of 31st July 1996 and 15th August 1996 be affirmed and the appeal dismissed with costs, the amount thereof to be certified by the Clerk of the Parliaments if not agreed between the parties. 4. Stewart (Appellant) v. Secretary of State for Scotland (Respondent) (Scotland)—The Report from the Appellate Committee was agreed to; it was ordered and adjudged that the Interlocutor of an Extra Division of the Court of Session of 20th March 1996 be affirmed and the appeal dismissed; and that there be no order as to costs in this House. 5. Barry (Petitioner) v. Midland Bank Plc (Respondents) (lodged 16th January)—The petition of Jacqueline Barry praying for leave to appeal was presented and referred to an Appeal Committee. 6. Regina v. Southwark Crown Court (Appellants) ex parte Bowles (Respondent) (On Appeal from a Divisional Court of the Queen’s Bench Division)—The appeal was set down for hearing and referred to an Appellate Committee. In re Ramada and another (Petitioners) (application for a writ of Habeas Corpus)—Upon application by the petitioners (the agents for the respondent consenting thereto), it was ordered that the petition be withdrawn and that there be no order as to costs. 8. Appeal Committee—The following Order was made pursuant to the 38th Report— Regina v. Secretary of State for the Home Department and another (Respondents) ex parte Franc”ois (A.P.) (Petitioner)—That leave to appeal be given, and that the petition of appeal be lodged by 26th January next. The House was adjourned during pleasure. The House was resumed. Papers 9. Negative Instruments—The following instruments were laid before the House and ordered to lie on the Table: 1. Construction (Use of Explosives) Regulations (Northern Ireland) 1997, laid under the Health and Safety at Work (Northern Ireland) Order 1978;   (—) 2. Papers not subject to parliamentary proceedings—The following papers were laid before the House and ordered to lie on the Table: 1. Report and Accounts for 1996–97 of the Planning Inspectorate Executive Agency, laid under the Exchequer and Audit Departments Act 1921; 2. Draft Code of Practice in connection with the exercise by Financial Investigators of the powers conferred by Schedule 2 to the Proceeds of Crime (Northern Ireland) Order 1996, laid under the Proceeds of Crime (Northern Ireland) Order 1996. Private Business 11. London Docklands Development Corporation (Transfer of Functions) Order 1998—The Chairman of Committees reported (pursuant to Private Business Standing Order 216) that in his opinion the draft Order laid before the House yesterday is such that, apart from the provisions of the Act authorising it to be made, it would require to be enacted by a private or hybrid bill. Public Business 12. Audit Commission Bill [HL]—A bill to consolidate Part III of the Local Government Finance Act 1982 and other enactments relating to the Audit Commission for Local Authorities and the National Health Service in England and Wales was presented by the Lord Chancellor, read a first time and ordered to be printed. (HL Bill 64) 13. Teaching and Higher Education Bill [HL]—The House again resolved itself into a Committee upon the bill; amendments were moved and (by leave of the Committee) withdrawn; the House was resumed. 14. Deregulation (Licence Transfers) Order 1997—It was moved by the Lord Hoyle that the draft Order laid before the House on 17th November 1997 be approved; the motion was agreed to. 15. Museums and Galleries (Northern Ireland) Order 1997—It was moved by the Lord Dubs that the draft Order laid before the House on 25th November 1997 be approved; after debate, the motion was agreed to. 16. Teaching and Higher Education Bill [HL]—The House again resolved itself into a Committee upon the bill; amendments were moved and (by leave of the Committee) withdrawn; amendments were agreed to; the House was resumed after Clause 22 stood part. The House was adjourned at twenty minutes before one o’clock in the morning of Friday 23rd January to Monday next, half-past two o’clock.
