COMPETITION BILL [HL]—FURTHER OBSERVATIONS

22.  The Committee reported on this Bill in November 1997.[6] Since then it has been amended, and next week the House will consider amendments made by the House of Commons to the Bill. The Department of Trade and Industry have helpfully provided a note on these amendments, which is printed with this Report.

23.  The Committee has considered the amendments to clause 54 and the new Schedule, which add powers which are subject to negative procedure. It has no comments to make on these powers.

24.  The Committee considered carefully the new clause after clause 50, as it enables the Secretary of State to prescribe the extent of the power conferred on him (by prescribing the meaning of "land agreements" and "vertical agreements"), but the power is made subject to affirmative procedure and the Committee considers this an adequate safeguard.

Recommendation

25.  There is nothing in the Commons amendments which the Committee wishes to draw to the attention of the House.
