50. COUNCIL DIRECTIVE ON THE BURDEN OF PROOF IN CASES OF DISCRIMINATION BASED ON SEX

Letter from Lord Tordoff, Chairman of the Committee, to The Rt Hon Andrew Smith MP, Minister for Employment, Welfare to Work and Equal Opportunities

  Thank you for your Explanatory Memorandum of 16 January concerning the Commission's Re-examined proposal of 25 November 1997 for the Directive.

  As you will know the Directive was adopted by the Council on 15 December and indeed the final text has now been published in the Official Journal. In these circumstances the opportunity for scrutiny is non-existent, though I acknowledge that the common position text was provided to the Committee on 4 November and a further opportunity for scrutiny will arise when the Directive is extended to the United Kingdom.

  In the meantime I would be grateful for an explanation as to why the Re-examined proposal and your Explanatory Memorandum were not made available to the Select Committee until 16 January.
