The House met at half-past two o’clock.

PRAYERS were read by the Lord Bishop of Blackburn.

Leave of Absence—It was ordered that the leave of absence granted to the Earl Waldegrave be terminated.

Oath—James Sherbrooke Earl Waldegrave took and subscribed the oath pursuant to statute.

Judicial Business

1. Newell and others (Original Appellants and Cross-respondents) v. Secretary of State for the Environment and another (Original Respondents and Cross-appellants) (England)— The cross-appeal of the Secretary of State for the Environment, Transport and the Regions was presented and it was ordered that in accordance with Standing Order VI the statement and appendix thereto be lodged on or before 28th December next.

2. Fletcher Estates (Harlescott) Limited (Original Appellants and Cross-respondents) v. Secretary of State for the Environment and another (Original Respondents and Cross-Appellants) (England)— The cross-appeal of the Secretary of State for the Environment, Transport and the Regions was presented and it was ordered that in accordance with Standing Order VI the statement and appendix thereto be lodged on or before 28th December next.

3. University College London Hospitals NHS Trust (Respondents) v. UNISON (Petitioners) (lodged 11th November)— The petition of UNISON praying for leave to appeal was presented and referred to an Appeal Committee.

4. Link Organisation plc (Petitioners) v. North Derbyshire Tertiary College and others (Respondents)— The petition of Link Organisation plc praying for leave to appeal notwithstanding that the time limited by Standing Order II has expired was presented and referred to an Appeal Committee.

5. Burton (Respondent) v. Mayor etc of the London Borough of Camden (Appellants)— The appeal was set down for hearing and referred to an Appellate Committee.

Russell (Valuation Officer) (Respondent)— The petition of the appellants praying that the time for lodging the statement and appendix and setting down the cause for hearing might be extended to 21st December next (the agents for the respondent consenting thereto) was presented; and it was ordered as prayed.

10. Harries (A.P.) (Appellant) v. Barclays Bank plc (Respondents)— The petition of the appellant praying that the time for lodging the statement and appendix and setting down the cause for hearing might be extended to 28th December next or to the third sitting day after the next ensuing meeting of the House (the agents for the respondents consenting thereto) was presented; and it was ordered as prayed.

11. West Bromwich Building Society (Appellants) v. Mander Hadley (Respondents)— The petition of the appellants praying that the time for lodging the statement and appendix and setting down the cause for hearing might be extended to 28th December next (the agents for the respondents consenting thereto) was presented; and it was ordered as prayed.

12. Dingley (A.P.) (Appellant) v. Chief Constable of Strathclyde Police (Respondent) (Scotland)— The petition of the appellant praying that the time for lodging the statement and appendix and setting down the cause for hearing might be extended to 28th December next or to the third sitting day after the next ensuing meeting of the House (the agents for the respondent consenting thereto) was presented; and it was ordered as prayed.

13. Chief Adjudication Officer (Appellant) v. Faulds (Respondent) (Scotland)— The petition of the appellant praying that the time for lodging the statement and appendix and setting down the cause for hearing might be extended to 21st December next (the agents for the respondent consenting thereto) was presented; and it was ordered as prayed.

14. In re Pinochet (application for a writ of Habeas Corpus) (On Appeal from a Divisional Court of the Queen’s Bench Division)— Upon application by the appellants (the agents for the respondents consenting thereto), it was ordered that the appeal be withdrawn.

18. Paper not subject to parliamentary proceedings—The following paper was laid before the House and ordered to lie on the Table:

    Report for 1997-98 of the Arts Council of Northern Ireland, laid under the National Lottery etc. Act 1993.

Private Business

19. London Local Authorities Bill [HL]— The bill was reported from the Unopposed Bill Committee with amendments.

Public Business

20. Procedure of the House—It was moved by the Chairman of Committees that the 4th Report from the Select Committee (HL Paper 144) be agreed to; then it was moved by the Earl Ferrers as an amendment thereto at end to insert (“except the recommendation relating to the Lord Chancellor’s Dress”); after debate, the amendment was disagreed to (see division list); then the original motion was agreed to.

21. Resistance to Antibiotics (S&T Report)— It was moved by the Lord Soulsby of Swaffham Prior that this House take note of the Report of the Science and Technology Committee, Resistance to Antibiotics and other antimicrobial agents (7th Report, HL Paper 81); after debate, the motion was agreed to.

22. Scotland Bill—The bill was returned from the Commons with certain amendments disagreed to with reasons for such disagreement, with other amendments disagreed to but with amendments proposed in lieu thereof, with an amendment agreed to with an amendment, and with the remaining amendments agreed to; the Commons amendments and reasons were ordered to be printed. (HL Bill 165)

23. Respiratory diseases of mineworkers—The Lord Lofthouse of Pontefract asked Her Majesty’s Government what progress is being made to deal with claims for compensation by mineworkers who are suffering from respiratory diseases such as bronchitis and emphysema; after debate, the question was answered by the Lord Sainsbury of Turville.

The House was adjourned at twenty-five minutes past midnight
