Time Zones and Summer Time (Devolution) Bill [H.L.]




Devolve to the Scottish Parliament and the National Assembly for Wales power to set time zones and summer time in Scotland and Wales respectively.

BE IT ENACTED by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:-

Summer Time Act to apply only to England.     1. - (1) The Summer Time Act 1972 shall be amended as follows.
      (2) In section 1 (advance of time during period of summer time), for the words "Great Britain" there shall be substituted the word "England".
      (3) Section 4 (Northern Ireland) shall cease to have effect.
Scottish Parliament to have power to vary time zones and summer time.     2. In section L5 of Head L (Miscellaneous) of Schedule 5 (reserved matters) to the Scotland Act 1998-
    (a) the words ", time zones and the subject-matter of the Summer Time Act 1972" shall be omitted; and
    (b) there shall be inserted as the first entry under the cross-heading Exceptions the following-
  " Time zones and the subject-matter of the Summer Time Act 1972.".
National Assembly for Wales to have power to vary time zones and summer time.     3. - (1) The Secretary of State shall, in exercise of his powers under section 25 (power to make specific transfers etc.) of the Government of Wales Act 1998, make provision for the transfer to the National Assembly for Wales ("the Assembly") of the power to-
    (a) vary the time zone applicable in Wales, and
    (b) vary the time for general purposes in Wales during the period of summer time.
      (2) In subsection (1) "the period of summer time" shall have the same meaning as in-
    (a) section 1(2) of the Summer Time Act 1972, or
    (b) an Order in Council made under section 2 of that Act which specifies a period instead of the period specified in section 1(2) of that Act and which is for the time being in force.
      (3) Nothing in this section shall give the Assembly power to vary the period of summer time as defined in subsection (2) above.
Repeals.     4. The enactments mentioned in the Schedule are repealed to the extent set out in the third column.
Short title.     5. This Act may be cited as the Time Zones and Summer Time (Devolution) Act 1999.
