 Application 
       .  This Part of this Schedule applies where there are three or more candidates in an Assembly constituency. 
 Candidate with overall majority of first preference votes 
       .  If one of the candidates to be a constituency member receives more than half of all the first preference votes given in the Assembly constituency that candidate shall be returned as the constituency member for that Assembly constituency. 
 No candidate with overall majority of first preference votes 
       .--(1)  If none of the candidates to be the constituency member receives more than half of all the first preference votes given in the Assembly constituency, the following provisions of this paragraph shall have effect.
 
    (2)  The candidate with the fewest number of first preference votes is eliminated, and the second preference votes given for that candidate shall be ascertained.
 
    (3)  The second preference votes under sub-paragraph (2) above shall be transferred to the other candidates, being added to the first preference votes cast for the other candidates.
 
    (4)  If, following the recalculation under sub-paragraph (3) above, none of the candidates receives more than half of the votes, the remaining candidate with the fewest number of votes is eliminated and the process in sub-paragraphs (2) and (3) above is carried out.

      (2)  If such registration is not completed in time for a party to submit a list to the Greater London returning officer within the time specified in paragraph 5(2) of Schedule 2 to the Greater London Authority Act 1999, that party shall not be eligible to participate in the election as a party nor its candidates to participate as London candidates for that party.
 
    (3)  A failure by the Registrar to register a party in time for it to participate in an ordinary election shall not affect or prejudice the result of the election and no action shall be brought against the Registrar or the returning officer in respect of such failure."")
