545A     Insert the following new Schedule-- 
 ("SCHEDULE 
 THE ENVIRONMENT STRATEGY GROUP FOR LONDON> 
 Membership 
     1.--(1)  The Environment Strategy Group for London shall consist of such number of members as the Mayor may from time to time determine.
 
    (2)  The members shall be appointed by the Mayor.
 
    (3)  The members shall be individuals--
    (a)  who are representatives of such bodies concerned with relevant matters as the Mayor considers appropriate; or
    (b)  who have knowledge, experience or expertise which is relevant to the functions of the Environment Strategy Group for London.
    (4)  Before appointing any member, the Mayor shall consult such bodies or persons as he considers appropriate.
 
    (5)  Before making an appointment by virtue of sub-paragraph (3)(a) above, the Mayor shall consult the authoritative body concerned.
 
    (6)  In sub-paragraph (3)(a) above "relevant matters" means any of the matters in relation to which the Environment Strategy may contain policy.
 
    (7)  In sub-paragraph (6) above "Environment Strategy" means all strategies on which the Environment Strategy Group is to be consulted.
 
 Tenure of office 
     2.--(1)  The members of the Environment Strategy Group for London shall hold and vacate office in accordance with the terms of their appointment.
 
    (2)  The terms of appointment of a member shall be such as the Mayor may determine.
 
    (3)  But a member may at any time resign his membership by giving notice to the Mayor.
 
    (4)  A person who ceases to be a member shall be eligible for re-appointment.
 
 Members' expenses 
     3.  The Mayor may pay members of the Environment Strategy Group for London allowances in respect of travel or other expenses properly incurred by them. 
 Staff, facilities and money 
     4.  The Mayor may provide the Environment Strategy Group for London with--
    (a)  staff,
    (b)  accommodation, equipment or other facilities, or
    (c)  sums of money towards defraying expenses properly incurred by them in carrying out their functions.
 
 Proceedings 
     5.--(1)  The quorum of the Environment Strategy Group for London and the arrangements relating to their meetings shall be such as they may determine.
 
    (2)  The validity of proceedings of the Environment Strategy Group for London is not affected by any vacancy among the members or any defect in the appointment of any member.")

    (2)  In that section, the words from "by and out of such Monies" to "by Authority of Parliament" shall cease to have effect.
 
    (3)  The functions transferred to the Authority by subsection (1) above shall be functions of the Authority which are exercisable by the Mayor acting on behalf of the Authority.")

553C*     Insert the following new Clause-- 
      (" .--(1) The land comprised in the site of the central garden of Parliament Square (which, at the passing of this Act, is vested in the Secretary of State for Culture, Media and Sport) is by this subsection transferred to and vested in Her Majesty as part of the hereditary possessions and revenues of Her Majesty.
 
    (2)  Nothing in subsection (1) above affects--
    (a)  any sewers, cables, mains, pipes or other apparatus under that site, or
    (b)  any interest which was, immediately before the passing of this Act, vested in London Regional Transport or any of its subsidiaries.
    (3)  The care, control, management and regulation of the central garden of Parliament Square shall be functions of the Authority.
 
    (4)  It shall be the duty of the Authority well and sufficiently to light, cleanse, water, pave, repair and keep in good order and condition the central garden of Parliament Square.
 
    (5)  The functions conferred or imposed on the Authority by this section are in addition to any other functions of the Authority.
Parliament Square.
     (6)  In consequence of the preceding provisions of this section, any functions of the Secretary of State under or by virtue of section 22 of the Crown Lands Act 1851 (duties and powers of management in relation to the royal parks, gardens and possessions there mentioned), so far as relating to the whole or any part of the central garden of Parliament Square, shall determine.
 
    (7)  Subsections (3) and (4) above shall have effect notwithstanding any law, statute, custom or usage to the contrary.
 
    (8)  Any functions conferred or imposed on the Authority by virtue of this section shall be functions of the Authority which are exercisable by the Mayor acting on behalf of the Authority.

     (9)  In this section "the central garden of Parliament Square" means the site in Parliament Square on which the Minister of Works was authorised by the Parliament Square (Improvement) Act 1949 to lay out the garden referred to in that Act as "the new central garden".")1949 c. lvi.
553D*     Insert the following new Clause-- 
      (" .--(1) The Authority may make such byelaws to be observed by persons using Trafalgar Square or Parliament Square Garden as the Authority considers necessary for securing the proper management of those Squares and the preservation of order and the prevention of abuses there.
 
    (2)  A person who contravenes or fails to comply with any byelaws under this section shall be guilty of an offence and liable on summary conviction to a fine not exceeding level 1 on the standard scale.
 
    (3)  The functions conferred or imposed on the Authority by this section are in addition to any other functions of the Authority.
 
    (4)  Any functions conferred or imposed on the Authority by virtue of this section shall be functions of the Authority which are exercisable by the Mayor acting on behalf of the Authority.
 
    (5)  In this section--
Byelaws.
 
    "Trafalgar Square" has the same meaning as in the Trafalgar Square Act 1844;
    "Parliament Square Garden" means the central garden of Parliament Square, within the meaning of section (Parliament Square) above.")

554     Insert the following new Clause-- 
 ("PART XA 
 THE RIVER THAMES 
     .--(1)  The Mayor shall prepare and publish a document to be known as the "River Thames strategy".
 
    (2)  The River Thames strategy shall contain the Mayor's proposals and policies--
    (a)  for the use of the River Thames for tourism and for passenger and freight transport, including the provision and maintenance of piers and other relevant infrastructure,
    (b)  for the provision, maintenance and protection of wharves required for cargo, waste and aggregates handling in the Port of London,
    (c)  for the provision and maintenance of moorings and other facilities for private leisure craft and houseboats,
    (d)  for the protection and enhancement of the ecology of the Thames, its tributaries and connection highways and the wildlife of the Thames and its habitats,
    (e)  for the use of the Thames and its banks for sport, leisure and recreation,
    (f)  for the provision and maintenance of public access to Thames-side and where appropriate to the foreshore, and
    (g)  for the protection of historic features and the enhancement of the built and natural environment of the River,
and may contain such other proposals and policies relating to the River Thames as the Mayor considers appropriate.
 
    (3)  The River Thames strategy shall also contain information about--
    (a)  water quality in the River,
    (b)  the local character of individual stretches of the River, including areas, sites buildings, structures, landmarks, skylines, landscapes and views of particular sensitivity and importance,
    (c)  opportunities for regeneration, environmental and urban design improvements, public access and recreation,
    (d)  sites of ecological or archaeological importance,
    (e)  land and river transport nodes for passenger, tourist or freight transport,
    (f)  the measures which are to be taken by the Authority, Transport for London and the London Development Agency for the purpose of the implementation of the River Thames strategy, and
    (g)  the measures which other persons or bodies are to be encouraged by the Mayor to take for the purpose of the implementation of the River Thames Strategy.
    (4)  The River Thames strategy shall define a special Thames policy area, having regard to--
    (a)  areas, open spaces and buildings with a visual relationship to and impact on the River, or whose uses relate to the River and river-related activities,
    (b)  existing designations such as conservation areas and world heritage sites, and
    (c)  specific geographical features of the River and adjacent land,
and shall include a statement formulating the Mayor's guidelines for spatial development in the Thames policy area.
 
    (5)  In preparing and revising the River Thames strategy the Mayor shall consult--
    (a)  the Port of London Authority,
    (b)  the Environment Agency,
    (c)  each riparian London borough council,
    (d)  the Common Council, and
    (e)  any other person or body whom the Mayor considers it appropriate to consult.
    (6)  In preparing or revising the statement referred to in subsection (4) above the Mayor shall--
    (a)  consult each riparian London borough council and the Common Council, and
    (b)  take account of such aspects of the Mayor's spatial development strategy as relate to the River Thames and to the Thames policy area.
    (7)  Where the Mayor revises the River Thames strategy, he shall publish it as revised.
 
    (8)  The River Thames strategy may make different provision for different parts of the River Thames.")
The River Thames strategy.
555     Insert the following new Clause-- 
      ("  .--(1)  Where the Secretary of State considers that either of the conditions specified in subsection (2) below is satisfied, he may give the Mayor a direction about the content of the River Thames strategy.
 
    (2)  The conditions mentioned in subsection (1) above are--
    (a)  that the River Thames strategy or its implementation is likely to be detrimental to any area outside Greater London, or
    (b)  that the River Thames strategy or its implementation is likely to be detrimental to the operations of the Port of London Authority, or to flood defences.
    (3)  The power of the Secretary of State to give a direction to the Mayor under subsection (1) above--
    (a)  may be exercised either generally or specially, and
    (b)  may only be exercised after consultation with the Mayor.
    (4)  Where the Secretary of State gives the Mayor a direction under subsection (1) above, the Mayor shall comply with the direction.")

556     Insert the following new Clause-- 
      ("  . For the purpose of sections (The River Thames strategy) and (The River Thames strategy: directions by Secretary of State) above, "River Thames" refers to that part of the River Thames located within Greater London, and to the tidal sections of any of its tributaries and creeks located within Greater London.")Interpretation of Part XA.

556ZA*     Insert the following new Clause-- 
      (".--(1) The Minister for the Civil Service may, to such extent and subject to such conditions as he thinks fit, delegate to any person the function of administering a scheme made under section 1 of the Superannuation Act 1972, so far as relating to employees of any of the bodies specified in section 337(1) above.The Superannuation Act 1972: delegation of functions.

     (2)  A person to whom the function of administering a scheme made under section 1 of the Superannuation Act 1972 is delegated under subsection (1)(a) above may, to such extent and subject to such conditions as he may determine, authorise the exercise of that function by, or by employees of, any person.1972 c. 11.
     (3)  Where a person is authorised under subsection (2) above to exercise the function of administering a scheme made under section 1 of the Superannuation Act 1972, anything done or omitted to be done by or in relation to him (or an employee of his) in, or in connection with, the exercise or purported exercise of the function shall be treated for all purposes as done or omitted to be done by the person who authorised him.
 
    (4)  Subsection (3) above does not apply for the purposes of--
    (a)  any criminal proceedings against the authorised person (or any employee of his); or
    (b)  any contract between him and the person who authorised him, so far as relating to the function.")
