Sanctions Policy

Baroness David asked Her Majesty's Government:

Baroness Symons of Vernham Dean: The Government have recently completed a wide-ranging review of their sanctions policy. All Whitehall departments with an interest in sanctions were involved in the review.

As a result, the Government have decided to launch a new policy of better targeted "smarter" sanctions. This will sharpen the focus and effectiveness of sanctions whilst trying to minimise their impact on ordinary people, including children, and on our own commercial and economic interests.

Apart from the threat of or use of force, which will remain essential in the more extreme cases, sanctions are the only coercive measure available to the international community to respond to challenges to international peace and security. The review concluded that they will remain an important tool of our foreign policy.

The review also concluded, however, that better targeting would be likely to enhance the effectiveness of international sanctions and minimise the risk of harm to ordinary people. A range of sanctions, of varying type and severity, is available and different measures may be selected depending on particular circumstances. Comprehensive sanctions should be reserved for cases where the objective is to isolate and contain a very serious transgressor.

The review concluded that, although the circumstances in which sanctions are imposed vary from case to case, there are a number of broad principles that should normally be followed. Sanctions should:



    include exemptions to minimise the humanitarian impact on innocent civilians.


    have clear objectives, including well-defined and realistic demands against which compliance can be judged, and a clear exit strategy.


    have effective arrangements for implementation and enforcement by all states, especially by neighbouring countries.


    avoid unnecessary adverse impact on UK economic and commercial interests.


    The review also agreed a revised set of inter-Departmental procedures for the efficient imposition, amendment and lifting of sanctions, as

    well as for their enforcement and monitoring. These will further improve co-ordination between Whitehall departments on sanctions issues.

I shall keep the House informed of current sanctions and their scope on a yearly basis. All new sanctions or any amendments to existing sanctions will be announced at the time. We shall shortly be laying in the Library of the House a list of all sanctions imposed by the UK. An updated version will be laid in the Library annually (or more frequently if policy changes require a revision).

Live Sheep Exports

Lord Hardy of Wath asked Her Majesty's Government:

    What action is being taken in regard to the export of sheep or any other farm livestock which are purchased for slaughter within another European Union state in circumstances which are not acceptable under both United Kingdom regulations and Article 9 of European Council Directive 93/119/EC.[HL1387]

The Parliamentary Secretary, Ministry of Agriculture, Fisheries and Food (Lord Donoughue): While the Government would prefer to prohibit the export of animals in such circumstances, the case law of the European Court has made clear that such an approach is not open to us and that we must look to the authorities in the member state of destination to enforce EU rules on their territory. However, the Government do not believe that British farmers would wish their sheep to be slaughtered in unacceptable and inhumane circumstances: we shall be appealing to the British sheep sector to consider the risk that sheep which they export to the continent at the present time may be slaughtered cruelly during the Eid el Kebir festival on 27-29 March.

Genetic Modification: Authorising Bodies

Viscount Thurso asked Her Majesty's Government:

    Which Government agencies or other bodies are responsible for authorising and regulating:


    (a) research into genetic modification in general and genetically modified foods in particular; and


    (b) the commercial production, sale and consumption by the public of genetically modified foods;


    and what resources, both financial and human, are provided to execute these functions.[HL1210]

Lord Donoughue: The Health and Safety Executive, the Department of the Environment, Transport and the Regions, the Scottish Office, the Northern Ireland Office and the Ministry of Agriculture, Fisheries and Food are the government agencies and departments responsible for authorising research into genetic modification.

Although MAFF is responsible for regulating the commercial production, sale and consumption by the public of genetically modified foods, the Scottish, Welsh and Northern Ireland Offices also have resources engaged in this area.

£5 million is being spent in 1998-99 in support of these functions, which includes £3.7 million on research to underpin the regulatory framework. A total of 74 people are currently deployed on this work (mainly policy development, research co-ordination and regulatory functions).

Provisional Seed Certification Scheme

Lord Beaumont of Whitley asked Her Majesty's Government:

    Further to the Written Answer by the Lord Donoughue on 1 March (WA 164), whether they will place in the Library of the House a copy of the letter sent to all maintainers and breeders' agents in 1975 establishing the non-statutory provisional seed scheme.[HL1389]

Lord Donoughue: Yes--I have now done so.

Lord Beaumont of Whitley asked Her Majesty's Government:

    Further to the Written Answer by Lord Donoughue on 1 March (WA 165), why none of the progeny of the parental lines of the genetically modified spring hybrid rape was brought forward for provisional certification; and why the national list application in respect of the hybrid variety obtained from the two parent lines was withdrawn.[HL1391]

Lord Donoughue: In both cases these were commercial decisions made by the applicant.
