Letter to the Chairman from Lord Whitty, Parliamentary Under-Secretary of State, Department of the Environment, Transport and the Regions

I sent to you on 3 December a memorandum on delegated powers in the Local Government Bill, which flagged up the Government's intention to bring forward amendments at Committee stage of which some would make amendments to these delegated powers, or introduce new powers.

The Government has now put down amendments to Parts II and V of the Bill, and I attach a copy of these amendments for your information. As promised in paragraph 68 of the original memorandum, we have prepared a supplementary memorandum covering all of the new and amended delegated powers introduced by these amendments; a copy is enclosed. Apart from these amendments, and the amendment to Part I about which I wrote to you on 10 January, none of the Government amendments proposed for Committee stage should have an impact on delegated powers under the Bill.

As indicated in the original memorandum, we intend to make available in time for consideration in Committee preliminary drafts of some of the regulations to be made available under Part II. We intend to do so later this week, and I will make sure that you receive copies of these as soon as possible.

Copies go to Baroness Hamwee, Lord Dixon-Smith, Baroness Farrington, Baroness Thornton and the Clerk to the Delegated Powers and Deregulation Committee.
