1.Rocky Mountain Traders Limited (Petitioners) v. Fellowes Manufacturing (UK) Limited (Respondents) and one other action—The petition of Rocky Mountain Traders Limited praying for leave to appeal was presented and referred to an Appeal Committee.
2.Abouzaid (Respondent) v. Mothercare UK Limited (Petitioners)—The petition of Mothercare UK Limited praying for leave to appeal was presented and referred to an Appeal Committee.
3.Ketley (Petitioner) v. Gilbert (Respondent)—The petition of Michael Ketley praying for leave to appeal was presented and referred to an Appeal Committee.

6.Medway Council Bill [hl]—The Chairman of Committees acquainted the House that, pursuant to the resolution of Thursday 18th January, the bill had been deposited in the Office of the Clerk of the Parliaments together with the declaration of the agent; the bill was presented, read a first time, passed through all its remaining stages pro forma and sent to the Commons.
7.Kent County Council Bill [hl]—The Chairman of Committees acquainted the House that, pursuant to the resolution of Thursday 18th January, the bill had been deposited in the Office of the Clerk of the Parliaments together with the declaration of the agent; the bill was presented, read a first time, passed through all its remaining stages pro forma and sent to the Commons.

Public Business

8.Human Rights—It was moved by the Chairman of Committees that the Commons message of 17th January be now considered, and that a Select Committee of six Lords be appointed to join with the Committee appointed by the Commons,

To consider and report on:

(a)matters relating to human rights in the United Kingdom (but excluding consideration of individual cases);
(b)proposals for remedial orders, draft remedial orders and remedial orders made under section 10 of and laid under Schedule 2 to the Human Rights Act 1998; and
(c)in respect of draft remedial orders and remedial orders, whether the special attention of the House should be drawn to them on any of the grounds specified in Standing Order 73 (Joint Committee on Statutory Instruments);

To report to the House:

(a)in relation to any document containing proposals laid before the House under paragraph 3 of the said Schedule 2, its recommendation whether a draft order in the same terms as the proposals should be laid before the House; or
(b)in relation to any draft order laid under paragraph 2 of the said Schedule 2, its recommendation whether the draft Order should be approved;

and to have power to report to the House on any matter arising from its consideration of the said proposals or draft orders; and

To report to the House in respect of any original order laid under paragraph 4 of the said Schedule 2, its recommendation whether:

(a)the order should be approved in the form in which it was originally laid before Parliament; or

(b)that the order should be replaced by a new order modifying the provisions of the original order; or
(c)that the order should not be approved,

and to have power to report to the House on any matter arising from its consideration of the said order or any replacement order;

That, as proposed by the Committee of Selection, the Lords following be named of the Committee:

That the Committee have power to agree with the Commons in the appointment of a Chairman;

That the Committee have power to appoint specialist advisers;

That the minutes of evidence taken before the Committee from time to time shall, if the Committee think fit, be printed and delivered out;

And that the Committee do meet with the Committee appointed by the Commons on Wednesday 31st January at half-past five o’clock in Committee Room 4B;

the motion was agreed to and it was ordered that a Message be sent to the Commons to acquaint them therewith.

9.Criminal Defence Service (Advice and Assistance) Bill [HL]—The House resolved itself into a Committee upon the bill; an amendment was moved and (by leave of the Committee) withdrawn; the House was resumed and the bill was reported without amendment.
10.Human Fertilisation and Embryology (Research Purposes) Regulations 2000—It was moved by the Lord Hunt of Kings Heath, that the draft Regulations laid before the House on 12th December be approved; then it was moved by the Lord Alton of Liverpool, as an amendment thereto, to leave out all the words after “That” and insert “this House declines to approve the draft Regulations laid before the House on 12th December until a Select Committee of the House of Lords has reported on the issues connected with human cloning and stem cell research”; after debate, the amendment was disagreed to (see division list); then it was moved by the Lord Walton of Detchant, as an amendment to Lord Hunt of Kings Heath’s motion, at end to insert “and that this House calls on the Government to support the appointment of a Select Committee of the House to report on the issues connected with human cloning and stem cell research, and to undertake to review the Regulations following the report of that Select Committee”; after debate, the amendment was agreed to; then the original motion, as amended, was agreed to.

The House was adjourned at half-past ten o’clock
till tomorrow, half-past two o’clock.
